The State Bar of California is trying to get Trump-allied attorney John Eastman’s law license taken away because of his brilliant legal strategy following the 2020 election. Eastman was the attorney who showed that it was perfectly legal for the vice president to send contested electors back to the swing states for a full accounting of the election.
The bar association and the media continue to claim that this was an attempt by Eastman to “overturn the election.” That is a bald-faced, shameless lie. No one was trying to overturn the election during the certification process on January 6, 2021. President Trump wasn’t trying to overturn it, John Eastman wasn’t trying to overturn it, and none of the mostly peaceful January 6 protesters were trying to overturn it.
The legal process and strategy, as outlined by Eastman, was for Mike Pence to send the electors back to Nevada, Arizona, Georgia, Minnesota, Michigan, and Pennsylvania. Those were the states where the most serious and voluminous allegations of 2020 election fraud originated. Then, in a measure led by Sen. Ted Cruz (R-TX), a government panel of five Representatives, five US Senators, and five Supreme Court Justices would take 10 days to examine the allegations of fraud and go from there.
Maybe the working group would have found fraud, maybe they wouldn’t have had time to do so. But that’s not trying to “overturn an election.” It’s literally the process that is laid out in the Electoral Count Act, which Congress enacted after the disputed 1876 election.
Eastman’s plan was to follow black-letter law to ensure that the election had been fair. The fact that he is now being treated so viciously is just further proof that the 2020 election was stolen. Innocent people don’t try to crush their political opponents for having differing opinions.
